2. WHAT ARE COOKIES?
A cookie is a file that is downloaded to your computer when accessing certain web pages. Cookies allow a website, among other things, to store and retrieve information about a user’s or their device’s browsing habits, and, depending on the information they contain and the way in which the device is used, they can be used to recognize the user.
Cookies are only associated with an anonymous user and their computer or device, and do not provide references that allow personal data to be known.
3. TYPES OF COOKIES
3.1 According to the entity that manages them
First-party cookies: These are sent to the user’s device from a computer or domain managed by the website editor and from which the service requested by the user is provided.
Third-party cookies: These are sent to the user’s device from a computer or domain that is not managed by the website editor, but by another entity that processes the data obtained through the cookies.
3.2 According to their purpose
There are many purposes for which cookies are used. Depending on the purpose for which the data obtained through cookies is processed, some of the purposes may include:
Technical cookies: These allow the user to navigate a website, platform, or application and to use the different options or services available on it. This includes those used by the editor to enable the management and operation of the website and to enable its functions and services, such as controlling traffic and data communication, identifying sessions, accessing restricted areas, remembering items in an order, processing a purchase, managing payments, controlling service security-related fraud, registering for an event, counting visits for software license billing purposes, using security features during browsing, storing content for video or audio broadcasting, enabling dynamic content (e.g., loading animations of text or images), or sharing content via social networks.
Technical cookies are exempt from compliance with the obligations established in Article 22.2 of the LSSI when they are used to provide the service expressly requested by the user. However, if such cookies are also used for non-exempt purposes (for example, for behavioral advertising), they will be subject to those obligations.
Preference or personalization cookies: These allow information to be remembered so that the user accesses the service with certain characteristics that may differentiate their experience from that of other users, such as language, the number of results displayed in a search, the appearance or content of the service depending on the browser used, or the region from which the service is accessed.
If it is the user themselves who chooses these features (for example, by selecting the language of a website by clicking on the corresponding country flag icon), such cookies are exempt from the obligations of Article 22.2 of the LSSI, provided that they are used exclusively for the purpose chosen.
Analytics or measurement cookies: These allow their controller to track and analyze the behavior of users of the websites to which they are linked, including quantifying the impact of advertisements. The information collected through this type of cookie is used to measure website, application, or platform activity, in order to introduce improvements based on the analysis of user usage data.
Behavioral advertising cookies: These store information on the behavior of users obtained through the continuous observation of their browsing habits, which allows a specific profile to be developed in order to display advertising based on it.
3.3 According to the length of time they remain active
Session cookies: Designed to collect and store data while the user accesses a website. They are typically used to store information needed only to provide the service requested by the user on a single occasion (for example, a list of purchased products) and disappear once the session ends.
Persistent cookies: Those in which the data remain stored on the device and can be accessed and processed for a period defined by the cookie controller, which may range from a few minutes to several years.
